By accessing or using DotComsMarket.com, creating an account, submitting information, listing a domain, making an offer, contacting a seller, accepting an offer, initiating a transaction, or otherwise using any feature of the platform, you agree to be bound by these Terms of Service. If you do not agree with these Terms, you should not use Dot Coms Market.

1. Platform Overview

Dot Coms Market is an online marketplace designed to support the listing, discovery, negotiation, purchase, and sale of domain names and related digital assets. Dot Coms Market provides marketplace tools and transaction support, but Dot Coms Market is not the owner of every domain listed on the platform unless expressly stated. Some domains may be owned by Dot Coms, Inc., its subsidiaries, affiliates, related entities, or third-party sellers. Users are responsible for carefully reviewing each listing and transaction before proceeding.

2. Relationship to Dot Coms, Inc.

Dot Coms Market operates as part of the broader Dot Coms, Inc. network. Dot Coms, Inc. may own, operate, support, manage, promote, or provide administrative, technical, marketplace, hosting, payment coordination, domain portfolio, digital asset, or related business services connected to Dot Coms Market.

References to “Dot Coms Market,” “DotComsMarket.com,” “we,” “us,” or “our” may refer to Dot Coms Market, Dot Coms, Inc., its subsidiaries, affiliated platforms, owners, officers, employees, contractors, representatives, service providers, or authorized agents, as applicable to the service or transaction involved.

3. User Eligibility

By using Dot Coms Market, you represent that you are at least the age of majority in your jurisdiction and have the legal authority to enter into binding agreements. If you are using the platform on behalf of a company, organization, partnership, trust, estate, agency, or other legal entity, you represent that you have authority to bind that entity to these Terms.

You may not use Dot Coms Market if you are prohibited by law from using online marketplace services, payment services, escrow services, domain transaction services, or any related third-party services required to complete a transaction.

4. Account Registration and Responsibility

You are responsible for maintaining the confidentiality of your account credentials, including your username, password, email access, authentication methods, and any related login details. You are responsible for all activity that occurs under your account, whether authorized by you or not, unless otherwise required by applicable law.

You agree to notify Dot Coms Market promptly if you believe your account has been accessed without authorization, compromised, misused, or involved in suspicious activity.

5. Account Suspension or Termination

Dot Coms Market may suspend, restrict, disable, or terminate any account at its discretion if we believe that the account is associated with fraud, attempted fraud, false information, suspicious activity, payment abuse, trademark abuse, unauthorized domain listings, harassment, misuse of the platform, security concerns, unlawful activity, violation of these Terms, or conduct that may create legal, operational, reputational, financial, or security risk for Dot Coms Market, Dot Coms, Inc., users, sellers, buyers, or third-party providers.

Dot Coms Market may also suspend or restrict access while reviewing a dispute, complaint, chargeback, ownership concern, legal demand, payment issue, or suspected violation.

6. Domain Listings

Sellers are solely responsible for ensuring that any domain they list on Dot Coms Market is owned by them, controlled by them, or lawfully authorized for sale by them. By listing a domain, the seller represents that they have the right and authority to offer the domain for sale and to transfer the domain if a transaction is completed.

Sellers agree that all listing information must be accurate, lawful, and not misleading. This includes domain spelling, extension, description, price, ownership status, category, traffic claims, revenue claims, age claims, registrar information, transfer requirements, and any other representation made about the domain or digital asset.

Dot Coms Market may review, approve, reject, edit, suspend, hide, or remove any listing at any time if we determine that the listing is inaccurate, incomplete, misleading, suspicious, unlawful, inappropriate, inactive, infringing, disputed, inconsistent with marketplace standards, or otherwise not suitable for the platform.

7. No Guarantee of Listing Approval

Submission of a domain listing does not guarantee approval, publication, promotion, continued availability, sale, buyer interest, offer activity, or marketplace placement. Dot Coms Market reserves the right to determine which domains and digital assets may appear on the platform.

Dot Coms Market may decline listings for any reason, including quality concerns, trademark concerns, legal concerns, ownership uncertainty, incomplete information, suspicious seller activity, inappropriate content, pricing irregularities, or lack of fit with the marketplace.

8. Offers, Bids, and Negotiations

Buyers may submit offers or bids through Dot Coms Market where such features are available. Submitting an offer does not guarantee acceptance, sale, transfer, ownership, reservation, exclusivity, or completion of a transaction.

Sellers may accept, reject, counter, or ignore offers unless a specific binding purchase process has been formally initiated and confirmed under applicable transaction terms. Dot Coms Market may facilitate communication, but users are responsible for reviewing the terms of any offer before accepting or proceeding.

Users agree not to submit fake offers, misleading offers, speculative offers with no intent to purchase, automated bids, harassing communications, fraudulent purchase inquiries, or offers designed to manipulate the marketplace.

9. Transaction Process

Once a buyer and seller agree on a price and basic transaction terms, the transaction may proceed through Escrow.com or another approved secure transaction method. Dot Coms Market may provide instructions, coordinate communication, or direct users to approved third-party services, but the specific transaction process may depend on the domain, seller, buyer, registrar, payment method, escrow provider, and applicable transfer requirements.

Users agree to follow all transaction instructions carefully and promptly. Failure to complete required steps may delay or prevent completion of the transaction.

10. Use of Escrow.com

Dot Coms Market may use Escrow.com for secure domain transactions. Escrow.com is a third-party escrow service and is not owned or controlled by Dot Coms Market or Dot Coms, Inc.

When Escrow.com is used, buyers and sellers may be required to create an Escrow.com account, complete identity verification, comply with Escrow.com’s terms, pay applicable escrow fees, follow Escrow.com’s instructions, and complete the transaction according to Escrow.com’s process.

Dot Coms Market does not control Escrow.com’s approval decisions, verification requirements, timelines, payment holds, compliance procedures, refund decisions, dispute handling, fee structure, or account review process. Users are responsible for reviewing and complying with Escrow.com’s own terms and procedures before participating in a transaction.

11. Payments

Payment terms may vary depending on the transaction. Payments may be processed through Escrow.com, approved payment processors, direct arrangements approved by Dot Coms Market, or other secure transaction methods. Users agree not to bypass approved payment processes, attempt unauthorized payment arrangements, or pressure another user to move a transaction outside approved channels.

Buyers are responsible for ensuring that payment is made in the required amount, currency, method, and timeframe. Sellers are responsible for cooperating with the approved transfer and release process once payment requirements are satisfied.

Dot Coms Market is not responsible for delays caused by bank processing, escrow review, identity verification, payment processor holds, chargebacks, insufficient funds, blocked transactions, regulatory checks, fraud screening, registrar delays, or third-party service restrictions.

12. Escrow Fees, Processing Fees, and Other Charges

Transactions may involve fees, including escrow fees, payment processing fees, marketplace fees, listing fees, commission fees, wire fees, registrar fees, domain renewal fees, transfer fees, taxes, currency conversion fees, or other charges. Unless otherwise stated in writing, users are responsible for reviewing and paying all applicable fees associated with their transaction.

Dot Coms Market may charge fees for platform services, listing services, promotional placement, marketplace access, transaction support, domain brokerage support, or other services. Fee structures may change at any time unless otherwise agreed in writing for a specific transaction.

13. Domain Transfers

Domain transfers are subject to registrar rules, registry rules, ICANN policies, transfer locks, authorization code requirements, account verification requirements, ownership verification, domain age restrictions, recent registration or transfer restrictions, pending disputes, legal holds, payment confirmation, and other technical or administrative requirements.

Buyers and sellers agree to cooperate in good faith to complete the transfer process. Sellers must provide accurate and timely transfer information once payment and escrow requirements have been satisfied. Buyers must provide accurate receiving account information and complete any required acceptance steps.

Dot Coms Market does not guarantee that a transfer will be completed by a specific date. Transfer timing may vary depending on registrar procedures, user responsiveness, escrow status, payment confirmation, and third-party systems.

14. Ownership Verification

Dot Coms Market may request proof of domain ownership, registrar screenshots, DNS verification, email verification, authorization information, identity verification, corporate authorization, or other documentation before approving a listing, allowing a transaction, or releasing transaction instructions.

Failure to provide requested verification may result in listing removal, account restriction, transaction delay, cancellation, or referral to the appropriate third-party provider for further review.

15. No Legal, Financial, Tax, or Investment Advice

Dot Coms Market provides a marketplace and related digital asset services. We do not provide legal, financial, tax, investment, trademark, accounting, or regulatory advice. Any information available on the platform, including domain descriptions, pricing, marketplace content, blog content, valuation language, or transaction guidance, is provided for general marketplace and informational purposes only.

Users are responsible for obtaining their own professional advice before making legal, financial, tax, trademark, investment, or business decisions.

16. No Guarantee of Domain Value

Domain values are subjective and may vary based on many factors, including extension, length, memorability, commercial relevance, search behavior, brandability, comparable sales, buyer demand, market conditions, timing, negotiation, and perceived business use.

Dot Coms Market does not guarantee that any domain will sell, receive offers, increase in value, produce traffic, generate revenue, rank in search engines, avoid trademark claims, or deliver any business result. Any price, description, estimate, appraisal language, category, marketplace placement, or promotional statement is not a guaranteed valuation or guaranteed sale price.

17. Buyer Due Diligence

Buyers are responsible for conducting their own due diligence before purchasing a domain. This may include reviewing the domain spelling, extension, registrar status, renewal requirements, trademark risk, prior use, search history, backlink profile, traffic claims, revenue claims, legal concerns, blacklist status, transfer eligibility, and intended business use.

Dot Coms Market does not guarantee that a domain is suitable for the buyer’s intended use. The buyer assumes responsibility for determining whether a domain meets their business, branding, legal, technical, and commercial needs.

18. Seller Responsibility

Sellers are responsible for ensuring that listed domains are accurately described, transferable, and lawfully offered for sale. Sellers may not list domains they do not own or control. Sellers may not misrepresent traffic, revenue, ownership, trademark status, history, search value, or other material information.

If a seller fails to complete a transaction after acceptance and payment requirements are satisfied, Dot Coms Market may suspend or terminate the seller’s account, remove listings, restrict future marketplace activity, or take other appropriate action.

19. Intellectual Property and Trademark Responsibility

Users are responsible for ensuring that their domain listings, domain purchases, domain use, descriptions, logos, content, and related activity do not infringe or violate the rights of any third party, including trademark rights, service mark rights, trade name rights, copyright rights, privacy rights, publicity rights, contractual rights, or other legal rights.

Dot Coms Market may remove or restrict any listing that appears to raise intellectual property concerns, trademark concerns, ownership concerns, fraud concerns, legal complaints, or rights disputes. Dot Coms Market may cooperate with lawful requests, court orders, arbitration decisions, registrar requirements, escrow provider requests, or other legal processes as appropriate.

20. Prohibited Domains and Listings

Dot Coms Market may prohibit or remove domains that appear to involve fraud, phishing, malware, spam, illegal activity, trademark abuse, impersonation, counterfeit activity, regulated goods or services, hate content, abusive content, adult exploitation, unlawful financial activity, deceptive practices, or any content or use that creates unacceptable risk for the platform.

Dot Coms Market reserves the right to determine whether a domain, listing, user, or transaction is acceptable for the marketplace.

21. Prohibited User Activity

Users may not use Dot Coms Market to engage in unlawful, fraudulent, abusive, deceptive, or harmful conduct. Prohibited activity includes, but is not limited to:

  • Listing domains without ownership or authority;
  • Submitting false or misleading information;
  • Making fake offers or bids;
  • Attempting to bypass escrow or approved transaction procedures;
  • Using the platform for phishing, malware, spam, or fraud;
  • Misrepresenting identity, authority, or affiliation;
  • Harassing, threatening, or abusing other users;
  • Attempting unauthorized access to accounts or systems;
  • Scraping, copying, or harvesting platform data without permission;
  • Interfering with website security or functionality;
  • Using bots, scripts, or automated tools in an unauthorized manner;
  • Creating multiple accounts to evade restrictions;
  • Submitting chargebacks or payment disputes in bad faith;
  • Using the marketplace to violate third-party rights.

22. Communications

Users may receive platform communications, transaction notices, account notifications, support replies, verification emails, security messages, listing updates, offer notifications, and other communications related to use of Dot Coms Market.

Users are responsible for maintaining a valid email address and checking messages related to marketplace activity. Dot Coms Market is not responsible for missed communications caused by incorrect email addresses, spam filters, blocked messages, user inattention, email server issues, or third-party mail delivery problems.

23. Off-Platform Communications and Transactions

Dot Coms Market strongly discourages users from moving transactions outside approved platform or escrow processes. Off-platform communications and transactions may increase the risk of fraud, non-payment, failed transfers, misrepresentation, and loss of transaction protection.

Dot Coms Market is not responsible for transactions, communications, payments, transfer arrangements, promises, side agreements, or disputes that occur outside the platform or outside approved transaction channels.

24. User Content

Users may submit listings, descriptions, messages, profile information, images, documents, support requests, transaction details, and other content. By submitting content, users represent that they have the right to submit it and that it does not violate any law, contract, or third-party right.

Users grant Dot Coms Market and Dot Coms, Inc. the right to use, display, reproduce, modify, store, distribute, and promote submitted content as reasonably necessary to operate, market, improve, and protect the platform.

25. Platform Content and Intellectual Property

All platform content, design elements, branding, logos, text, graphics, software, layouts, marketplace structure, interface elements, and related materials are owned by or licensed to Dot Coms Market, Dot Coms, Inc., or their respective rights holders.

Dot Coms Market and Dot Coms, Inc. are not responsible for third-party websites or services, including their content, availability, security, fees, decisions, errors, delays, account restrictions, data practices, or transaction procedures.

27. Marketplace Availability

Dot Coms Market may update, modify, suspend, restrict, or discontinue any part of the platform at any time. We may perform maintenance, improve functionality, revise features, change listing rules, update policies, restrict access, or remove services when necessary.

We do not guarantee uninterrupted access, error-free operation, permanent availability of any feature, or continued publication of any listing.

28. Security

Users agree not to interfere with the security, integrity, or operation of Dot Coms Market. Users may not attempt unauthorized access, introduce malware, exploit vulnerabilities, overload systems, bypass authentication, manipulate transaction flows, or compromise platform data.

Dot Coms Market may take action to protect the platform, users, transactions, data, and related systems, including blocking access, limiting accounts, requiring verification, removing content, or reporting suspicious activity.

29. Privacy

Use of Dot Coms Market may involve the collection and processing of personal information, account information, communication records, transaction information, technical data, and other information necessary to operate the platform. 30. Disputes Between Users

Dot Coms Market may, but is not required to, assist with communication or review when a dispute arises between buyers and sellers. Users remain responsible for their own conduct, representations, payments, transfer obligations, and transaction decisions.

If a transaction is handled through Escrow.com, disputes may be subject to Escrow.com’s procedures. Dot Coms Market does not control Escrow.com’s dispute process or final determinations.

31. Limitation of Liability

To the fullest extent permitted by law, Dot Coms Market, Dot Coms, Inc., and their owners, officers, directors, employees, contractors, affiliates, representatives, licensors, service providers, and agents shall not be liable for indirect, incidental, special, consequential, exemplary, punitive, business-loss, revenue-loss, profit-loss, data-loss, goodwill-loss, or opportunity-loss damages arising out of or related to use of the platform.

This limitation applies to claims involving marketplace use, domain listings, failed transactions, payment issues, escrow delays, transfer delays, account restrictions, third-party services, user disputes, inaccurate listings, technical interruptions, unauthorized account access, or inability to use the platform.

32. Disclaimer of Warranties

Dot Coms Market is provided on an as-is and as-available basis. To the fullest extent permitted by law, Dot Coms Market and Dot Coms, Inc. disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security.

We do not warrant that the platform will be uninterrupted, error-free, secure, free of harmful components, or that any domain listing, offer, transaction, buyer, seller, or transfer will meet user expectations.

33. Indemnification

You agree to indemnify, defend, and hold harmless Dot Coms Market, Dot Coms, Inc., their owners, officers, directors, employees, contractors, affiliates, representatives, licensors, service providers, and agents from and against any claims, liabilities, damages, losses, costs, expenses, demands, actions, or proceedings, including reasonable attorney fees, arising out of or related to:

  • Your use or misuse of the platform;
  • Your domain listings or attempted listings;
  • Your offers, bids, purchases, sales, or transaction activity;
  • Your violation of these Terms;
  • Your violation of any law or regulation;
  • Your violation of any third-party right;
  • Your misrepresentation of ownership, authority, price, traffic, value, or domain status;
  • Your communications with other users;
  • Your use of third-party services connected to a transaction.

34. Changes to the Platform

Dot Coms Market may change, improve, restrict, suspend, or discontinue any part of the platform without prior notice. This may include features, listings, categories, fees, transaction procedures, account tools, communication systems, or support options.

35. Changes to These Terms

36. Governing Terms for Specific Transactions
